Refusal / removal authority
South Dakota has no non-uniform pre-filing fraud refusal — only uniform technical grounds in §57A-9-516(b). §57A-9-502's debtor SSN/TIN requirement is a sufficiency rule, not a fraud screen. §22-11-23.2 separately requires debtor authorization for financing-statement filings (misdemeanor) — it is not a clerk fraud screen.

Real-property liens
§43-31-40 is a repealed homestead/tax section and was never a fraudulent-lien statute. Live tools: register may refuse a counterfeit lien as defined in §22-11-29 (§7-9-19); §22-11-28 (Class 1 misdemeanor / second offense Class 6 felony); §22-11-28.1 (false/forged instrument for recording — Class 6 felony); civil liability under §20-9-33. Not a TX-style forged-deed affidavit.

Under §7-9-19 the register of deeds can refuse a counterfeit lien (defined in §22-11-29). A person whose document is refused may bring a circuit-court action for an order directing the register to record it (§7-9-20); if the court finds the register acted reasonably or in good faith in refusing, the register is not liable for civil damages (§7-9-21). If the register has reason to believe a document already recorded is counterfeit, the register must give written notice of the recording to the property owners (§7-9-22) — a notice, not a removal. Criminal referral under §22-11-28 / §22-11-28.1; civil damages and fees under §20-9-33 for a §22-11-28 violation.
If it's already recorded: Register's written notice to owners of a recorded document it believes counterfeit (§7-9-22; a notice, not a removal); counterfeit-lien criminal penalties; civil damages/fees under §20-9-33; harassment-threat companion §22-11-31 / §20-9-34 exist but are not the primary cleanup path.
Real-property records are held by the register of deeds where the property sits.

A free "property fraud alert" service is available in at least part of South Dakota — it emails or mails you whenever a document gets recorded against your name, so you find out right away instead of months later. Sign up for South Dakota Land Notification →

If the path runs through court
South Dakota doesn't have a self-filed administrative form for this — the verified remedy runs through a court, which generally means an attorney rather than a fill-in-the-blank document.
Counterfeit-Lien Refusal, Criminal Referral, and Civil Damages
South Dakota's register of deeds may refuse a document the register has reasonable cause to believe is a counterfeit lien as defined in §22-11-29 (§7-9-19). Companion criminal statutes: §22-11-28 (counterfeit lien — Class 1 misdemeanor; second offense Class 6 felony) and §22-11-28.1 (false/forged instrument for recording — Class 6 felony). §20-9-33 provides civil damages, attorney's fees, and costs for a §22-11-28 violation. §43-31-40 is repealed.
