Refusal / removal authority
The filing officer can refuse a UCC filing outright if it wasn't created pursuant to the UCC, was filed for an improper purpose (to harass or hinder), lists the debtor as its own secured party, or covers collateral outside the UCC's scope — no referral required.

- S.C. Code §36-9-501(c), (d)
Clerk decides directly. A refusal can be appealed to the South Carolina Administrative Law Court.
If it's already filed: Information statement under §36-9-518; when an information statement alleges a record was filed wrongfully and should have been rejected under §36-9-516(b)(8) or (9), §36-9-518(e) requires the Secretary of State to decide that promptly and cancel a record it finds was wrongfully filed. §36-9-625 provides damages remedies, not expungement. §36-9-501(c) makes knowingly filing a false or fraudulent financing statement (or one filed to hinder or harass) a felony; on conviction the court may find it ineffective and order the filing office to terminate or purge it. §36-9-501(d) provides a debtor named in such a filing a civil action that may seek an order declaring it ineffective, ordering it terminated or purged, and reasonable attorney fees.
Real-property liens
The clerk or register of deeds can refuse to file — and can remove, after 30 days' notice — any document reasonably believed to be materially false, fraudulent, or a sham legal process. A clerk acting in good faith is immune from liability either way.
SC §30-9-30
Full citations
- S.C. Code §30-9-30(B)
Clerk/register refuses or removes on reasonable belief of fraud; 30-day notice before removal, with the filer able to go to court to contest it.
Real-property records are held by the County Register of Deeds (or Clerk of Court in counties without a separate register) — search or contact them directly.
Get notified before it happens
A free "property fraud alert" service is available in at least part of South Carolina — it emails or mails you whenever a document gets recorded against your name, so you find out right away instead of months later. Sign up for Greenville County FraudSleuth →
South Carolina's largest county. Requires creating a free Register-of-Deeds search account first. Horry, Beaufort, Dorchester, and Georgetown Counties run separate systems.
If you're a government official or employee
A separate, distinct pathway: a judgment or lien can't be accepted against a present or former government official or employee unless a court or government body authorized it. It comes with its own notice-of-invalid-lien procedure and civil remedies — actual damages, punitive damages, costs, and attorney's fees under §30-9-35(D).

How this usually works in South Carolina
A summary of the tools South Carolina law and filing offices provide — general information, not instructions for your facts. Confirm current practice with the filing office and talk to an attorney about your situation.
- 1South Carolina's free UCC search is linked on this page; County Registers of Deeds hold real-property records.
- 2South Carolina filing offices have direct authority to refuse on a reasonable belief of fraud — §36-9-516(b) for UCC filings and §30-9-30(B) for real property — and §36-9-518(e) provides cancellation of a UCC record found to have been wrongly filed.
- 3§30-9-35 is a separate, faster pathway for current and former government officials and employees, including actual and punitive damages, costs, and attorney's fees.
What to expect
Of the states with real data behind this site, South Carolina has the most direct, fastest-moving process — a clerk can act on a reasonable belief of fraud without waiting on an outside referral.
