Refusal / removal authority

Rhode Island's filing office may refuse an initial financing statement or amendment not submitted by a 'trusted filer' if it reasonably believes the record was communicated with intent to harass or defraud the debtor, or if there's reasonable cause to believe it's materially false or unauthorized, asserts a claim against a current or former public officer or employee tied to their official duties without a security agreement or judgment, or shows the debtor and secured party as substantially the same person.

Refusal at the filing office under §6A-9-516(b)(8); the office has no duty to investigate or ascertain facts about intent. A record initially refused under this ground can later be accepted if additional information resolves the concern.

If it's already filed: A full Affidavit-of-Wrongful-Filing process under §6A-9-513.1: the debtor delivers a sworn affidavit alleging the filing was unauthorized and intended to harass or defraud; the office files a termination statement (effective 60 days later, with certified-mail notice to the secured party); the secured party can request an expedited administrative review or sue for reinstatement in Superior Court on an expedited basis, with fee-shifting against a secured party found to have filed with intent to harass or defraud.

Real-property liens

R.I. Gen. Laws §11-18-35 (added by 2026-S 2715A / 2026-H 7551aa, P.L. 2026, ch. 55 / ch. 54, enacted June 10, 2026, effective upon passage) creates 'real estate title fraud' as a felony when a person, with intent to defraud, knowingly records or offers for recording a deed with a forged transferor signature, a fraudulently created instrument, a fraudulent mortgage/lien/instrument claiming an interest in real estate, falsely encumbers another's real estate, or attempts/transfers an interest by known forgery or false document — punishable by up to 10 years and a $50,000 fine (up to 20 years and $100,000 for a pattern, plus restitution). Owners who are victims may sue under §11-18-35(g) for the greater of actual damages or $5,000, plus costs and reasonable attorney's fees. On and after September 1, 2027, municipal recorders gain remote e-filing ID rules and may temporarily delay, report, or notify notaries about 'suspicious documents' from non–trusted submitters. Companion §11-18-36 requires each municipality to offer a free property-alert system not later than January 1, 2028.

Criminal offense and civil damages under §11-18-35 are in effect (act effective upon passage; enacted June 10, 2026). Recorder delay/report powers and remote e-filing ID rules activate September 1, 2027. Free municipal property alerts must be stood up by January 1, 2028 under §11-18-36. Recorders acting in good faith are generally protected from damages claims.

If it's already recorded: Civil action for the greater of actual damages or $5,000 plus attorney's fees under §11-18-35(g); felony prosecution under §11-18-35(f).

Real-property records are managed at the municipal level in Rhode Island — contact the recorder / city or town clerk where the property sits. Starting January 1, 2028, municipalities must also offer a free property-alert notification system under §11-18-36.

Get notified before it happens

Rhode Island has a free "property fraud alert" service — it emails or mails you whenever a document gets recorded against your name, so you find out right away instead of months later. Sign up for West Warwick Fraud Alert (interim example) →

R.I. Gen. Laws §11-18-36 (2026-S 2715A / H 7551aa) requires every municipality to offer a free property-alert system not later than Jan. 1, 2028 (notify within 10 business days). Until then, only some towns have programs — West Warwick is one example; Providence still has no confirmed program as of 2026-08-01.

If you're a government official or employee

The filing office may refuse a financing statement that asserts a claim against a current or former government officer or employee tied to their official duties, unless the filer holds a properly executed security agreement or a court judgment.

No official form: Affidavit of Wrongful Filing

When this research was done, the Rhode Island Secretary of State's UCC pages and current UCC rules did not mention §6A-9-513.1 or publish a form for it (the law took effect July 1, 2026). Under the enacted bill text, a debtor may deliver a sworn affidavit that a financing statement was unauthorized or filed to harass or defraud. The office may reject an incomplete affidavit, or one it believes was delivered to harass or defraud the secured party. Otherwise it files a termination statement effective 60 days later, after certified-mail notice to the secured party, who may contest through an expedited administrative review or in Superior Court. Records from a designated trusted filer go through an administrative review first instead of automatic termination.

How this usually works in Rhode Island

A summary of the tools Rhode Island law and filing offices provide — general information, not instructions for your facts. Confirm current practice with the filing office and talk to an attorney about your situation.

  1. 1Rhode Island's free UCC database is linked on this page; municipal recorders and city or town clerks hold real-property records.
  2. 2§6A-9-513.1 provides a sworn Affidavit of Wrongful Filing for UCC filings that are fraudulent, harassing, unauthorized, or target a public officer or employee. The office may reject an incomplete or harassing affidavit, runs an administrative review first for trusted-filer records, and otherwise files a termination effective 60 days later unless the secured party successfully contests it.
  3. 3§11-18-35 makes fraudulent real-estate filing a felony and gives a direct civil action for actual damages or $5,000 (whichever is greater) plus attorney's fees, without waiting on a criminal case.
  4. 4Effective dates differ: UCC refusal and affidavit tools July 1, 2026; title-fraud criminal and civil tools on passage in June 2026; recorder suspicious-document powers September 1, 2027; municipal alerts by January 1, 2028. City and town clerks can confirm local practice.

What to expect

Rhode Island now has dedicated UCC refusal/affidavit tools (effective July 1, 2026) and a dedicated real-estate title-fraud felony with civil damages (2026-S 2715A / H 7551aa, P.L. 2026, ch. 55 / ch. 54, effective upon passage; enacted June 10, 2026). Recorder screening of suspicious remote filings and statewide municipal alerts are staged for 2027–2028. Day-to-day practice is still developing — confirm with the Secretary of State's office, your municipal clerk, or a local attorney.
