Relevant case law: After a federal jury convicted him of a heroin conspiracy, while he was still waiting to be sentenced, the defendant filed UCC financing statements with New York’s Department of State naming the trial judge and the prosecutor as debtors and claiming a security interest in all of their assets, land, and personal property. The Department of State recorded the statements in its ministerial role. About two months later he mailed the prosecutor a “Notification of Private Disposition of Collateral” purporting to sell her property, and mailed the judge a $9.5 million invoice for “unauthorized-use fees.” He claimed a self-executing “security agreement” and a common-law copyright in his own name. The Southern District of New York held the liens were wholly without merit and were filed to interfere with enforcement of the criminal laws, declared them null and void, and barred him from filing similar papers against those officials or other federal employees without the court’s permission. Verified. (United States v. Rodriguez Ramirez, 291 F. Supp. 2d 266 (S.D.N.Y. 2003).)

Refusal / removal authority

New York has no non-uniform pre-filing fraud refusal authority — §9-516(b) stops at uniform mechanical grounds. The distinctive post-filing tool is §9-518(d): a special proceeding to expunge or redact a falsely filed financing statement when the debtor is a state or local government employee (with a limited attorney exception).

  • No non-uniform pre-filing authority identified
  • N.Y. UCC §9-518(d)

There is no pre-filing content/fraud review to invoke. After filing, eligible employee-debtors can use the §9-518(d) special proceeding.

If it's already filed: §9-518(d) expunge/redact (employee debtors); information statement; §9-625.

Real-property liens

Real Property Law §329 is a general action to cancel certain instruments of record — useful but not a dedicated fraudulent-lien or forged-deed statute. Instruments “required by law to be recorded” are carved out of §329.

  • N.Y. Real Prop. Law §329

Court action to cancel the instrument of record under §329 for instruments not required by law to be recorded; expect ordinary quiet-title / cancel practice rather than a clerk counter-refusal.

If it's already recorded: Court cancellation under §329; other Lien Law articles require a specific section number before this site will cite them.

Real-property records are held by the county clerk / city register where the property sits.

Get notified before it happens

A free "property fraud alert" service is available in at least part of New York — it emails or mails you whenever a document gets recorded against your name, so you find out right away instead of months later. Sign up for NYC Notice of Recorded Document (ACRIS) →

Covers all 5 NYC boroughs via the Dept. of Finance / Office of the City Register (signup form). Overview page: nyc.gov/site/finance/property/deed-fraud-protection.page. Nassau County runs a separate program for the rest of Long Island; most other NY counties are unconfirmed.

If the path runs through court

New York doesn't have a self-filed administrative form for this — the verified remedy runs through a court, which generally means an attorney rather than a fill-in-the-blank document.

Special Proceeding to Expunge or Redact (Employee-Debtors)

New York has no pre-filing UCC fraud screen at all — the one distinctive tool is a special proceeding under §9-518(d), available when the debtor named on a falsely filed financing statement is a state or local government employee. It lets the employee-debtor get the record expunged or redacted. The statute also contains a limited attorney exception, whose exact scope is worth asking counsel about directly.

This generally requires an attorney. A special proceeding is a court filing, not something submitted to the Department of State — there's no administrative expungement path outside this statute. The "limited attorney exception" language in the statute itself is a detail specific enough that it needs a lawyer to interpret correctly rather than guess at here.

Action to Cancel an Instrument of Record

For real-property records, §329 is a general court action to cancel an instrument of record — not a statute written specifically for fraudulent liens, but a usable general-purpose tool. It does not reach instruments “required by law to be recorded.” Expect ordinary quiet-title / cancel-of-record practice rather than a clerk-level fix.

This generally requires an attorney. This is ordinary civil litigation practice (quiet title / cancel-of-record), and §329 itself is general-purpose rather than a detailed fraud-specific procedure — the site's research didn't find a more specific New York Lien Law article/section that fits better, so a bare "Lien Law" citation without a section number is not a reliable source. An attorney can confirm whether a more specific provision applies to your facts, and whether the instrument is outside §329's carve-out.

People consulting an attorney about a filing like this often bring:

  • A copy of the filing, if available, and where and when it was filed or recorded (office, date, and document or instrument number)
  • Any notices, letters, or other correspondence about it
  • Records for the property or account it names, such as a deed, title, or loan papers
  • Notes on any contact with the filer or the filing office, with dates
  • This page's citations and their check dates
