Relevant case law: Two defendants fought a bank foreclosure on a vacant lot with a flood of confusing, groundless filings and appeals. The appellate court described the tactics as the kind of “paper terrorism” associated with sovereign-citizen playbooks, affirmed the foreclosure judgment, and later imposed a $5,000 sanction for a frivolous appeal. The opinion also points to Illinois criminal and administrative tools aimed at people who cloud title with theories courts do not recognize. Verified. (Parkway Bank & Trust Co. v. Korzen, 2013 IL App (1st) 130380.)

Refusal / removal authority

The filing office can refuse a UCC filing it believes in good faith was communicated in violation of §9-501.1(a) — including records filed with intent to harass or defraud the person named as debtor or any other person — or that mislabels a debtor as a transmitting utility — decided internally by the Department of Business Services with General Counsel sign-off.

Internal referral model, similar in shape to Arkansas's. A filer whose record was wrongly refused can go to court to compel filing; a reinstated filing keeps its original filing date.

If it's already filed: Administrative termination on affidavit under §9-501.1; for county-recorder-level real property, referral to an Administrative Law Judge under §3-5010.5.

Real-property liens

Under 55 ILCS 5/3-5010.5 (as amended by Public Act 104-0382 / SB 1523, effective January 1, 2026), every county recorder shall establish a fraud referral and review process for deeds and instruments the recorder reasonably believes may be fraudulent, unlawfully altered, or intended to unlawfully cloud or transfer title. (The section's findings paragraph, subsection (a), still says a recorder "may establish" such a process; the amended subsection (c) says "Every recorder shall establish" one.) Suspected filings are referred to an administrative law judge; a fraud judgment is then recorded so the instrument does not affect the chain of title. Separately, §3-5010.11 creates a private right of action against a person who knowingly files such a deed or instrument. This is not a Texas-style owner affidavit and not a same-day clerk delete.

The county recorder can refer a suspected fraudulent recording for ALJ review under §3-5010.5 (counties under 3 million population must publish 90 days’ notice before standing up the process). Owners also have the §3-5010.11 private action. Nothing in §3-5010.5 requires an owner to use the referral process.

Real-property records are held by the County Recorder (or Recorder of Deeds) — contact them directly.

Get notified before it happens

Illinois has a free "property fraud alert" service — it emails or mails you whenever a document gets recorded against your name, so you find out right away instead of months later. Sign up for Cook County Property Fraud Alert →

Public Act 104-0382 (SB 1523), effective Jan. 1, 2026, requires every Illinois county to maintain a property fraud alert system (55 ILCS 5/3-5010.10). Cook County’s signup is the largest-county example; other counties run their own portals.

Official form: Form UCC57 — Uniform Commercial Code Affidavit of Fraudulent Record

Illinois publishes form UCC57 for 810 ILCS 5/9-501.1. A purported debtor uses it to describe the defects in a financing statement believed to be fraudulent. On receipt, the Secretary of State terminates the filing and gives the secured party 30 days' written notice to submit evidence refuting the claim; the secured party can seek reinstatement if it successfully contests.

How this usually works in Illinois

A summary of the tools Illinois law and filing offices provide — general information, not instructions for your facts. Confirm current practice with the filing office and talk to an attorney about your situation.

  1. 1The Illinois Secretary of State's free UCC search is linked on this page; County Recorders hold real-property records.
  2. 2A UCC filing that appears to have been made to defraud or harass can be refused after internal review by the Department of Business Services and General Counsel.
  3. 3For a fraudulent real-property recording, §3-5010.5 provides a county recorder fraud-referral and administrative-law-judge process, and §3-5010.10 requires county property fraud alert systems.
  4. 4If a valid filing is wrongly refused, Illinois law allows a court action to compel filing, and a reinstated record keeps its original filing date.

What to expect

Illinois’ real-property tools are administrative (recorder → ALJ) plus a private court action — plan for weeks, not a same-day clerk fix. County rollout of the mandatory referral process can lag the Jan. 1, 2026 effective date where 90-day notice still applies.
