Relevant case law: A man recorded a UCC financing statement against another person at Hawaii’s Bureau of Conveyances. The person named had no contract with him, owed him nothing, and had not signed or consented to the filing, and petitioned under Hawaii’s chapter 507D nonconsensual-common-law-lien statutes. The Circuit Court of the First Circuit expunged the filing as a nonconsensual common-law lien because the filer had not attached a court order authorizing it, awarded damages, and issued injunctive relief. The Intermediate Court of Appeals affirmed. Verified. (Connors v. Cassidy, No. 28070 (Haw. Ct. App. Apr. 7, 2009) (SDO).)

Refusal / removal authority

Hawaii has no separate non-uniform Article 9 provision authorizing the filing office to refuse ordinary UCC financing statements for general fraud. The live pre-filing gate is chapter 507D's nonconsensual common-law lien (NCCL) / frivolous financing scheme: the registrar shall not accept an NCCL claim without a certified court order (§507D-5(c)), and unauthorized financing statements have a demand-and-terminate path under §507D-4.

NCCL filings without a certified court order must be refused. For unauthorized financing statements, §507D-4 sets a demand for the security agreement and termination if it is not produced. Ordinary Article 9 refusal remains the uniform mechanical grounds under §490:9-516 / §490:9-520.

If it's already filed: §507D-7 expungement and sanctions; §490:9-518 / §490:9-625.

Real-property liens

The same §507D-5(c) court-order requirement applies to recording NCCL claims — the registrar may not accept them without a certified state or federal court order.

Get notified before it happens

Hawaii has a free "property fraud alert" service — it emails or mails you whenever a document gets recorded against your name, so you find out right away instead of months later. Sign up for Property Watch — Bureau of Conveyances →

Hawaii records real property centrally, so this one portal covers the whole state. The state itself warns it won't prevent a fraudulent recording and can produce false positives.

If you're a government official or employee

Claims of lien against federal, state, or county officers or employees based on performance of duties are invalid unless accompanied by a certified court order, and must be captioned accordingly.

No official form: Request to determine the validity of a financing statement

The Bureau of Conveyances forms page lists no form for a §507D-4(b) request. The statute describes a request (not a sworn affidavit) that identifies the financing statement by document number and carries a processing fee set by the registrar. The registrar then demands the underlying security agreement from the secured party by certified or registered mail; if it is not produced within 30 days, the registrar issues and accepts for filing a notice of unauthorized filing.

What to expect

Hawaii is protective against NCCL-style filings at the front door, but ordinary UCC fraud outside chapter 507D still leans on uniform Article 9 and court tools. Confirm the current fee on the state's official site — filing and search fees change and are not published here.
